Terms & Conditions of Using Dharmayana

PLEASE READ ALL THE TERMS AND CONDITIONS OF USE OF DHARMAYANA AND THE DHARMAYANA PRIVACY POLICY CAREFULLY AND THOROUGHLY BEFORE USING ANY FEATURES AND/OR SERVICES AVAILABLE ON THE DHARMAYANA PLATFORM.

The following are the Terms and Conditions of Use of the Dharmayana Platform ("Terms and Conditions") containing all the rules and regulations that are automatically binding when you visit, download, install, use the Dharmayana Platform and/or enjoy all the features and facilities provided on the Dharmayana Platform. Please read carefully the entire contents of the Terms and Conditions to understand the limitations of your rights and obligations as a User of the Dharmayana Platform. If you do not agree with the contents of these Terms and Conditions, you can stop accessing the Dharmayana Platform.

We may update these Terms and Conditions from time to time. Such updates will be effective after We display them on the Dharmayana Platform. It is your responsibility to review the Terms and Conditions periodically. Your continued use of the Dharmayana Platform after any such updates automatically binds you.

1. DEFINITIONS

Affiliates are (i) controlling parties of; (ii) subsidiaries of; or (iii) parties under the same control of OIT Innovations Private Limited.
Dharmayana services consist of Main Services offered to Users through the Dharmayana Platform which We may add, change and/or update from time to time as regulated in Article 6 of these Terms and Conditions.
Main Services consist of features such as Panchanga, Festivals, Janma Kundali, Kundali Matching, Astrologer Consultations, Prarthana and Daily prediction Services offered to Users through the Dharmayana Platform which We may add, change and/or update from time to time.
Main Services also include Ayurvedic Consultation — an online video consultation service connecting users with qualified Ayurvedic doctors (BAMS) for general wellness guidance rooted in Indian Ayurvedic tradition.
Special Services consist of features such as Janma Kundali, Kundali Matching, Astrologer Consultations offered to Users through the Dharmayana Platform which We may add, change and/or update from time to time.
The Dharmayana platform is a system that exists on website pages, mobile website pages, mobile applications, and other applications with the domain address https://dharmayana.in/ managed by Dharmayana.

2. GENERAL PROVISIONS

Dharmayana may use third party services to provide payment and delivery services. If there is a failure in the payment system and/or delay in order delivery, Dharmayana will make every effort to assist you in resolving any problems that may arise. Furthermore, you understand that the banking or payment service provider and delivery service selected by the User may charge a Delivery Fee and/or other fees (if any) to the User for the use of the services provided.
The Dharmayana Platform allows you to submit requests for Dharmayana Services to Service Providers. Service Providers have their own policies and full authority to accept or reject any of your requests for Dharmayana Services. If the Service Provider accepts your request, the Dharmayana Platform will notify you and provide information about the Service Provider, including the order number and the ability to contact the Service Provider by phone.
Every Dharmayana feature and/or Service available on the Dharmayana Platform can be updated or changed according to the needs and developments of the Dharmayana Platform.

3. PRIVACY POLICY

You can use the Dharmayana Platform by first registering and providing your personal data information, including but not limited to your full name, email address, mobile phone number, and any information related to your personal history that is necessary for providing personalized services, creating your profile, and enhancing your user experience.
These Terms and Conditions are an agreement in electronic form and your action of pressing the 'REGISTER' button (or equivalent) when opening an account on the Dharmayana Platform or the 'LOGIN' button when accessing your account constitutes your active consent to be bound by an agreement with Us so that the validity of these Terms and Conditions and the Privacy Policy are valid and legally binding and continue to apply throughout your use of the Dharmayana Platform and Dharmayana Services.
If you are using the Dharmayana Platform on behalf of an individual other than yourself, you represent that you are authorized by that individual to act on that individual's behalf and that that individual acknowledges the practices and policies outlined in the Privacy Policy.
You shall not raise any claim or objection to the validity of these Terms and Conditions or the Privacy Policy made in electronic form.

4. TERMS OF USE OF THE DHARMAYANA PLATFORM

We are pleased to invite you to register as a Dharmayana Platform User, after fulfilling the following general requirements:

You are an individual who has the right to enter into a binding agreement under the laws of the Republic of India and that you are at least 18 (eighteen) years old or married and not under guardianship or guardianship;
You are a legal entity/business entity with legality as required by Us and the laws and regulations applicable in the legal jurisdiction. If you register on behalf of a business entity, you also declare that you are authorized to act for and on behalf of the legal entity and to enter into and bind the legal entity/entity to the Terms and Conditions;
You declare that you are not an individual and/or legal entity prohibited by the laws of the Republic of India from receiving or using Dharmayana Services;
You declare that the agreement with Dharmayana does not violate any provisions, agreements, rights and other obligations with a third party; and/or
We have the right to conduct an inspection at any time regarding the truth, validity of information or documents submitted to Dharmayana or the Dharmayana Platform. If fraud or inconsistency is found based on independent assessment, Dharmayana has the right to terminate, cancel, or block your access and membership to the Dharmayana Platform or Dharmayana Services.
After registering on the Dharmayana Platform, you will get a personal account that can be accessed with a One Time Password (OTP) that will be sent to the mobile number you registered with Us. We hope that you do not submit, transfer or authorise anyone else to use your identity or use your account.
You will use the Dharmayana Platform only for the purpose of obtaining Dharmayana Services, and will not misuse or use the Dharmayana Platform for any unlawful activity, including but not limited to money laundering, theft, embezzlement, terrorism or fraud. You also agree that you will not make false orders through the Dharmayana Platform and will not commit any unlawful acts through the Dharmayana Platform.
You acknowledge and agree that any information in any form, including but not limited to video, audio, images or writings contained in the Dharmayana Platform has intellectual property rights (including but not limited to trademark rights and copyrights) respectively. You are not permitted to use, modify, facilitate, distribute and/or mutilate such intellectual property rights without permission from the owner of such intellectual property rights as stipulated in applicable laws and regulations.
The Dharmayana platform has links to sites operated by third parties. These links are provided for your convenience and will only be used to provide access to the third party sites and not for any other purpose.
If you have any problems with the services provided on the Dharmayana Platform, you can contact the Consumer Complaint Service that we have provided on the Dharmayana Platform to help handle your problems. Contact us at Dharmayana-feedback.

When accessing and using the Dharmayana Platform including all its features and services, you are not permitted to:

transfer your account on the Dharmayana Platform to another party without prior consent from Us;
spreading viruses, spam or other similar technologies that can damage and/or harm the Dharmayana Platform and other Dharmayana Platform users;
insert or move features on the Dharmayana Platform without Our consent;
use the Dharmayana Platform to distribute advertising or other materials;
You acknowledge and agree that the Service Prices listed on the Dharmayana Platform may change in accordance with the policies of the Service Provider and/or Dharmayana.

5. AYURVEDIC CONSULTATION — SPECIFIC TERMS

This section is new and applies specifically to the Ayurvedic Consultation feature on the Dharmayana Platform.

5.1 Nature of Service

The Ayurvedic Consultation feature enables users to consult with qualified Ayurvedic doctors via online video sessions. This service is intended for general Ayurvedic wellness guidance only. It is NOT a substitute for emergency medical care, in-person diagnosis, or treatment of serious medical conditions. Dharmayana is a technology platform facilitating access to doctors and does not itself provide medical advice.

5.2 Doctor Qualifications

All Ayurvedic doctors on Dharmayana hold a valid BAMS (Bachelor of Ayurvedic Medicine and Surgery) degree and are registered with their respective State Ayurvedic or Indian Medicine Council. Doctor qualifications and State Council registration numbers are verified by Dharmayana prior to onboarding and displayed on each doctor's profile.

5.3 Age Restriction

The Ayurvedic Consultation feature is available only to users aged 18 years and above. By booking a session, you confirm that you are 18 years of age or older. Dharmayana reserves the right to cancel any booking made by a user found to be under 18, with a full refund.

5.4 User Responsibilities

By booking an Ayurvedic Consultation, you agree to:

Provide accurate information in the intake form (name, age, gender, date of birth)
Disclose any known allergies, existing medical conditions, or current medications to your doctor at the start of the session
Use the service only for personal wellness guidance and not for emergency or acute medical conditions
Consult an in-person doctor immediately if symptoms worsen or in case of any emergency

5.5 Adverse Reactions Disclaimer

All remedy recommendations are made solely by the licensed Ayurvedic doctor. Dharmayana does not prescribe, dispense, or sell any medicines. If you experience any adverse reaction to a recommended remedy, stop using it immediately and consult a registered medical practitioner in person. Dharmayana shall not be held liable for any adverse reactions arising from remedies recommended during the consultation.

5.6 e-Remedy

Following the consultation, the Ayurvedic doctor may issue an e-Remedy — a text-based set of recommendations which may include Ayurvedic lifestyle guidance, Prarthana (devotional practices), or Dhyana (meditation) sessions available within the Dharmayana app. The e-Remedy is a wellness recommendation only and does not constitute a formal medical prescription.

5.7 Cancellation and Refund

Doctor no-show: Full refund initiated automatically
Platform technical failure: Full refund initiated
User-initiated cancellation: Self-service cancellation to be introduced in a future release. Contact Customer Support for assistance.

5.8 Dakshina - Token of Gratitude

Dakshina on the Dharmayana Platform is a voluntary expression of gratitude — similar to a tip or incentive — that users may offer to Jyotishis and temples for a service. It is not a donation or charitable contribution in any form and does not qualify for tax exemption or deduction under applicable Indian laws. The full Dakshina amount is passed on directly to the service provider. Dharmayana does not retain any part of it.

5.9 Regulatory Compliance

This service operates in compliance with the Central Council of Indian Medicine (CCIM) Telemedicine Guidelines, Ministry of AYUSH Telemedicine Regulations, and the Digital Personal Data Protection Act (DPDPA), 2023.

6. ACCOUNT SECURITY

The security and confidentiality of your Dharmayana account, including your registered name, registered mobile phone number, and verification code generated and sent by Our system is entirely your personal responsibility. All losses and risks resulting from your negligence in maintaining security and confidentiality as mentioned are borne by you alone.

Notify Us immediately if You know or suspect that Your account has been used without Your knowledge and consent.

7. INTELLECTUAL PROPERTY

OIT Innovations PVT LTD is the sole owner of the name, icon, and logo, which are copyright and trademarks protected by law. Users may not use, modify, or install the name, icon, logo, or trademark without written consent from OIT Innovations PVT LTD.

All intellectual property rights contained in the Dharmayana Platform are based on the laws of the Republic of INDIA. Users are prohibited from violating the intellectual property rights contained in this Dharmayana Platform, including making modifications, derivative works, adapting, copying, selling, remaking, hacking, and/or exploiting the Dharmayana Platform.

Users are only permitted to use the Dharmayana Platform solely for personal needs and cannot be transferred.

8. ACCOUNT DELETION

You can delete your account by accessing the 'Delete Account' option available on the Dharmayana Platform.

9. DHARMAYANA SOFTWARE TERMS

In order to provide the best service to You, We will occasionally make updates to the Dharmayana Service application automatically depending on the type of service or with Your consent to update Our application.

10. POLICIES AND CHANGES

We reserve the right at any time to make changes to the site, policies, terms of service, and Terms and Conditions and subsequently posted to you in the media we provide. All changes, additions, deletions, modifications and others that We make related to the service will automatically take effect within 1x24 hours after being downloaded and announced by Dharmayana.
